Welcome to Domain Pilot. These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Domain Pilot ("Domain Pilot," "we," "us," or "our") governing your use of the Domain Pilot platform, including our website, web application, mobile applications, API, and all related services (collectively, the "Service").

By accessing or using the Service, you expressly and irrevocably agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not access or use the Service under any circumstances.

1. Introduction and Acceptance of Terms

We may modify these Terms at any time at our sole discretion. Changes will be effective immediately upon posting. Your continued use of the Service following any such modifications constitutes your acceptance of the revised Terms. It is your responsibility to review these Terms periodically.

2. Description of Service

Domain Pilot is a unified domain management platform that provides:

Multi-Registrar Integration: Connection to multiple domain registrars (including but not limited to GoDaddy, Namecheap, Cloudflare, and others) through API connections using credentials you provide
Domain Monitoring: Centralized dashboard for monitoring domain expiration dates, renewal status, and domain portfolio overview
DNS Management: Unified interface for managing DNS records across multiple registrars
Uptime Monitoring: Website and service uptime monitoring with real-time alerts
Notification Services: Automated alerts via email, SMS, push notifications, and other channels for domain expirations, renewals, and downtime events
Reporting and Analytics: Domain portfolio analytics, cost tracking, and management insights

Domain Pilot acts as an intermediary platform connecting to your third-party registrar accounts. We do not act as a domain registrar and do not directly register, transfer, or manage domain registrations on your behalf.

3. Account Registration and Security

3.1 Account Creation

To use the Service, you must:

Provide accurate, current, and complete registration information
Be at least 18 years of age or the age of majority in your jurisdiction
Have the legal authority to enter into this binding agreement
Maintain only one account per user (multiple accounts may be terminated without notice)

3.2 Account Security

You are solely responsible for:

Maintaining the confidentiality of your account credentials (email, password, API keys)
All activities that occur under your account, including unauthorized access
The security of third-party API keys and credentials you provide to connect registrar accounts
Immediately notifying us of any unauthorized use of your account or security breach

CRITICAL SECURITY WARNING: Domain Pilot stores and uses your third-party registrar API credentials to access your domain accounts. You acknowledge and agree that:

You are granting Domain Pilot permission to access your registrar accounts on your behalf
Any actions performed through Domain Pilot using your credentials are your responsibility
All API keys and credentials are encrypted using industry-standard encryption (AES-256 or equivalent)
We implement a zero-knowledge architecture where your API credentials are encrypted at rest and we do not have access to the plain-text versions of your credentials
Credentials are only decrypted temporarily in secure, isolated environments when making authorized API calls on your behalf
We implement industry-standard security measures but cannot guarantee absolute security
You should use registrar accounts with appropriate permission levels (read/write access as needed)

3.3 Account Suspension and Termination

We reserve the right, in our sole discretion, to:

Refuse account creation to any person or entity
Suspend or terminate your account immediately without prior notice for:
- Violation of these Terms
- Abusive, fraudulent, or illegal activity
- Excessive API usage that impacts service stability
- Non-payment of fees
- Providing false or misleading information
- Any activity that creates liability or disruption to our Service
Terminate inactive accounts after 180 days of inactivity

4. Registrar API Connections and Data Access

4.1 Third-Party Integration

Domain Pilot connects to third-party domain registrars using API keys and credentials you provide. You acknowledge that:

You must have proper authorization to connect registrar accounts
You are responsible for ensuring your registrar accounts permit third-party API access
We are not responsible for changes, limitations, or discontinuation of registrar APIs
Registrar terms of service may prohibit or restrict third-party access
You must comply with all terms of service of connected registrars

4.2 Data Synchronization

The Service synchronizes data from your registrar accounts, including:

Domain names, registration dates, and expiration dates
DNS records and nameserver information
Billing and renewal information
Registrar account details and contact information

Important: Domain Pilot provides monitoring and management tools based on data retrieved from registrars. We make commercially reasonable efforts to maintain accurate data, but:

Data accuracy depends on registrar API reliability
Synchronization may be delayed due to API limitations or connectivity issues
You remain solely responsible for ensuring domains are renewed and maintained at the registrar level
Domain Pilot is a supplementary tool and not a replacement for managing domains at your registrar

4.3 No Domain Registration Services

Domain Pilot does NOT:

Register domains on your behalf
Process domain renewals directly (except through registrar APIs with explicit authorization)
Act as a domain registrar or reseller
Store domain ownership credentials beyond API access tokens
Guarantee domain renewal or prevent expiration

You are ultimately responsible for ensuring your domains are properly renewed at your registrar.

5. Acceptable Use Policy

5.1 Permitted Use

The Service is intended for legitimate domain management purposes, including:

Monitoring and managing your own domain portfolio
Managing domains on behalf of clients (with proper authorization)
Tracking domain expirations and renewals
Monitoring website uptime for domains you own or manage

5.2 Prohibited Conduct

You agree NOT to use the Service for:

Illegal Activities:

Any illegal, fraudulent, or unlawful purpose
Violating any local, state, national, or international law or regulation
Infringing intellectual property rights of others
Phishing, identity theft, or fraud

Abusive Behavior:

Harassment, threatening, or abusive conduct toward other users or our staff
Creating accounts using false or misleading information
Impersonating any person or entity
Attempting to gain unauthorized access to accounts, systems, or networks

System Abuse:

Interfering with or disrupting the Service or servers/networks connected to the Service
Attempting to probe, scan, or test system vulnerabilities
Transmitting viruses, malware, or any destructive code
Circumventing security features or authentication measures
Using automated tools (bots, scrapers, crawlers) without explicit written permission
Reverse engineering, decompiling, or disassembling any part of the Service
Excessive API requests that burden our infrastructure (rate limits apply)

Monitoring Abuse:

Monitoring domains you do not own or have authorization to monitor
Using the Service to track competitors' domain portfolios without authorization
Monitoring websites in violation of their terms of service or robots.txt
Conducting denial-of-service (DoS) attacks under the guise of "monitoring"
Using uptime monitoring features to conduct network reconnaissance

5.3 Monitoring and Enforcement

We reserve the right to:

Monitor usage patterns and investigate suspicious activity
Review account activity to ensure compliance with these Terms
Suspend or terminate accounts for suspected violations without prior notice
Report illegal activity to law enforcement authorities
Remove content or monitors that violate these Terms
Impose rate limits or usage restrictions at our sole discretion

We have zero tolerance for abuse. Accounts engaged in prohibited conduct will be immediately suspended or terminated without refund.

6. Service Availability and Reliability

6.1 Service Level

We strive to provide reliable service availability but:

The Service is provided on an "as is" and "as available" basis
We do not guarantee uninterrupted, error-free, or secure service
Scheduled and emergency maintenance may temporarily interrupt service
Third-party registrar API outages may affect functionality
Notification delivery (email, SMS, push) depends on third-party services

6.2 No Warranty of Accuracy

While we make commercially reasonable efforts to provide accurate monitoring and alerts:

We do not guarantee the accuracy, completeness, or timeliness of data
Domain expiration dates and DNS information may be outdated or incorrect
Uptime monitoring may produce false positives or miss actual downtime
Notification delivery may be delayed or fail due to factors beyond our control

YOU ACKNOWLEDGE THAT DOMAIN PILOT IS A SUPPLEMENTARY TOOL AND SHOULD NOT BE YOUR SOLE METHOD OF MONITORING CRITICAL DOMAINS.

6.3 Maintenance and Updates

We may:

Perform scheduled maintenance with advance notice when possible
Make emergency updates without notice
Modify, suspend, or discontinue features at any time
Change system requirements, compatibility, or supported platforms

7. Payment Terms and Subscriptions

7.1 Pricing and Plans

Domain Pilot offers various subscription plans, including:

Free Plan (if available): Limited features for personal, non-commercial use
Paid Plans: Various tiers with different feature sets and usage limits
Lifetime Deal (LTD): One-time payment for specified lifetime access (terms provided at purchase)
Enterprise Plans: Custom pricing and features

Current pricing is available on our website and may change at any time with 30 days' notice to existing subscribers.

7.2 Billing and Payment

For paid subscriptions:

Billing occurs in advance on a monthly or annual basis (as selected)
Payment must be made by credit card, debit card, or other approved payment methods
You authorize us to charge your payment method on each billing cycle
All fees are non-refundable except as expressly stated in Section 7.4
You are responsible for all taxes, duties, and governmental assessments

7.3 Automatic Renewal

Subscriptions automatically renew unless you cancel before the renewal date:

Monthly subscriptions renew on the same day each month
Annual subscriptions renew on the anniversary date
You will be charged the then-current rate upon renewal
We will attempt to notify you before renewal, but notification failure does not waive renewal charges

7.4 Cancellation and Refunds

Cancellation:

You may cancel your subscription at any time through your account settings
Cancellation takes effect at the end of the current billing period
Access continues until the end of the paid period
No refunds for partial periods or unused services

Refund Policy:

New paid subscriptions: Full refund available within 30 days of first payment
Lifetime Deals: Refund available within 60 days of purchase (as specified in LTD terms)
After the refund period: All payments are final and non-refundable
No refunds for account terminations due to Terms violations
Refund requests must be submitted via email to support@domainpilot.io

7.5 Delinquent Accounts

If payment fails:

We will attempt to process payment multiple times
Your account may be downgraded or suspended after 7 days
Your account may be terminated after 30 days
You remain liable for all unpaid fees plus reasonable collection costs

8. Intellectual Property Rights

8.1 Our Intellectual Property

All content, features, and functionality of the Service, including:

Software, code, algorithms, and architecture
Text, graphics, logos, trademarks, and service marks
Design, layout, and user interface
Documentation and help materials

are owned by Domain Pilot or our licensors and protected by copyright, trademark, patent, and other intellectual property laws.

8.2 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to:

Access and use the Service for your internal business purposes
Use mobile apps and software we provide on authorized devices

You may NOT:

Copy, modify, distribute, sell, or lease any part of the Service
Reverse engineer or attempt to extract source code
Remove or modify proprietary notices or labels
Create derivative works based on the Service
Use our trademarks without written permission

8.3 User Data

You retain ownership of all domain data, DNS configurations, and content you provide. By using the Service, you grant us a limited license to:

Store and process your data to provide the Service
Display domain and DNS information in your dashboard
Use aggregated, anonymized data for analytics and service improvement

8.4 Feedback

Any suggestions, ideas, or feedback you provide about the Service become our property. We may use feedback without restriction or compensation.

9. Data Privacy and Security

9.1 Privacy Policy

Our collection, use, and protection of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to our Privacy Policy.

9.2 Data Security

We implement industry-standard security measures to protect your data, including:

Encryption of data in transit (TLS/SSL) - All communications between your browser and our servers are encrypted
Encryption of sensitive data at rest - All stored data is encrypted using AES-256 or equivalent encryption standards
Zero-knowledge encryption for API credentials - Your registrar API keys and access credentials are encrypted with keys that only you control through your account password. Our systems cannot decrypt your API credentials without your active session
Secure key management - Encryption keys are stored separately from encrypted data and managed through secure key management systems
Isolated credential processing - API credentials are only decrypted in secure, isolated environments during authorized API operations
No plain-text storage - We never store API keys, passwords, or sensitive credentials in plain text
Regular security audits and penetration testing
Access controls and multi-factor authentication
Role-based access control (RBAC) for team accounts
Automated threat detection and monitoring
Security incident response procedures

Zero-Knowledge Architecture: Domain Pilot is designed with a zero-knowledge security model for sensitive credentials, meaning:

We cannot view, access, or retrieve your registrar API keys in plain text
Your credentials are encrypted client-side before transmission whenever possible
Decryption only occurs in memory during active API operations
Credentials are immediately purged from memory after use
Even Domain Pilot employees cannot access your plain-text API credentials

However, no system is completely secure. We cannot guarantee absolute security and are not responsible for unauthorized access resulting from circumstances beyond our reasonable control.

9.3 Your Security Responsibilities

While we implement strong security measures, you are also responsible for:

Choosing strong passwords - Use unique, complex passwords for your Domain Pilot account
Protecting your credentials - Never share your account password or leave your account logged in on shared devices
Securing your registrar accounts - Ensure your registrar accounts have strong security settings
Using appropriate API permissions - Grant only the minimum necessary permissions when creating registrar API keys
Monitoring account activity - Regularly review your account activity logs for suspicious behavior
Enabling MFA - Enable multi-factor authentication if available on your account
Keeping software updated - Maintain updated browsers and operating systems
Reporting security issues - Immediately report any suspected security breaches to security@domainpilot.io

IMPORTANT: Your account password is the key to decrypting your stored API credentials. If you lose your password and cannot recover it, we cannot retrieve your encrypted API credentials. You will need to re-enter all registrar API keys after password recovery.

9.4 Data Retention

We retain your data:

While your account is active
For a reasonable period after account termination for backup and legal compliance
As required by law or to resolve disputes

You may request data deletion by contacting support, subject to legal retention requirements.

10. Disclaimers and Warranties

10.1 Service Disclaimer

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

IMPLIED WARRANTIES OF MERCHANTABILITY
FITNESS FOR A PARTICULAR PURPOSE
NON-INFRINGEMENT
ACCURACY, RELIABILITY, OR AVAILABILITY
ERROR-FREE OR UNINTERRUPTED OPERATION
FREEDOM FROM VIRUSES OR HARMFUL COMPONENTS

10.2 Third-Party Integrations

WE MAKE NO WARRANTIES REGARDING:

Third-party registrar API availability or accuracy
Compatibility with your registrar accounts
Continued support for any specific registrar integration
Actions taken by registrars affecting your domains

10.3 Monitoring Limitations

WE DO NOT WARRANT THAT:

Domain expiration monitoring will be 100% accurate or timely
Uptime monitoring will detect all outages or downtime events
Notifications will be delivered without delay or failure
DNS management changes will propagate immediately or correctly

10.4 Critical Systems Warning

DOMAIN PILOT IS NOT SUITABLE AS THE SOLE MONITORING SOLUTION FOR MISSION-CRITICAL SYSTEMS. You should implement redundant monitoring and management systems for critical infrastructure.

11. Limitation of Liability

11.1 Exclusion of Damages

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DOMAIN PILOT, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR:

Indirect Damages:

Indirect, incidental, special, consequential, or punitive damages
Loss of profits, revenue, business opportunities, or goodwill
Loss of data or business interruption
Cost of substitute services or procurement

Domain-Related Losses:

Loss of domain names due to expiration or failure to renew
Loss of business or revenue due to domain downtime
Damages from incorrect DNS configurations
Penalties or legal liability from domain expiration

Monitoring Failures:

Failure to detect downtime or send notifications
False positive or false negative monitoring results
Delayed or failed notification delivery

11.2 Liability Cap

IN NO EVENT SHALL OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE EXCEED THE GREATER OF:

The amount you paid to Domain Pilot in the 12 months preceding the claim, or
$100 USD

This limitation applies regardless of the legal theory (contract, tort, negligence, strict liability, or otherwise) and even if we have been advised of the possibility of such damages.

11.3 Jurisdiction-Specific Provisions

Some jurisdictions do not allow exclusion or limitation of liability for consequential or incidental damages. In such jurisdictions, our liability is limited to the maximum extent permitted by law.

12. Indemnification

You agree to defend, indemnify, and hold harmless Domain Pilot, its parent companies, subsidiaries, affiliates, officers, directors, employees, agents, contractors, and licensors from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or related to:

Your use or misuse of the Service
Violation of these Terms or any applicable law
Violation of any third-party rights, including intellectual property or privacy rights
Domain registration or management decisions you make using the Service
DNS configurations or changes made through the Service
Any content, data, or information you submit to the Service
Your registrar account access or credentials
Claims that your use of the Service caused harm to another party
Unauthorized use of your account resulting from your failure to maintain security

We reserve the right to assume exclusive defense and control of any matter subject to indemnification, in which case you will cooperate with us in asserting available defenses.

13. Dispute Resolution and Governing Law

13.1 Governing Law

These Terms and any disputes arising out of or related to the Service shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to conflict of law principles.

13.2 Arbitration Agreement

PLEASE READ THIS CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.

You and Domain Pilot agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be settled by binding arbitration, except that:

Either party may seek injunctive or equitable relief in court
Small claims court actions are permitted
Claims of intellectual property infringement may be brought in court

Class Action Waiver: YOU AND DOMAIN PILOT AGREE THAT DISPUTES MUST BE BROUGHT IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, REPRESENTATIVE, MULTIPLE PLAINTIFF, OR SIMILAR PROCEEDING.

13.3 Informal Resolution

Before filing an arbitration claim, you agree to:

Send written notice of the dispute to legal@domainpilot.io
Describe the nature of the claim and desired resolution
Negotiate in good faith for 30 days to resolve the dispute informally

13.4 Time Limitation

Any claim or cause of action related to the Service must be filed within one (1) year after the claim arose, or it will be permanently barred.

14. General Provisions

14.1 Entire Agreement

These Terms, together with our Privacy Policy and any additional terms provided at purchase, constitute the entire agreement between you and Domain Pilot regarding the Service and supersede all prior agreements, negotiations, and communications.

14.2 Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, or if not possible, severed from these Terms. The remaining provisions shall continue in full force and effect.

14.3 No Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. No waiver by us shall be effective unless made in writing and signed by an authorized representative.

14.4 Assignment

You may not assign or transfer these Terms or your account without our prior written consent. We may freely assign or transfer these Terms or our rights and obligations under these Terms without notice or consent.

14.5 Force Majeure

We shall not be liable for any delay or failure to perform resulting from causes beyond our reasonable control, including but not limited to:

Acts of God, natural disasters, or severe weather
War, terrorism, civil unrest, or government action
Internet service provider failures or outages
Third-party service provider failures
Strikes, labor disputes, or supply chain disruptions
Cyberattacks or security incidents

14.6 Electronic Communications

You consent to receive electronic communications from us, including:

Emails to your registered email address
Notifications within the Service
Updates to these Terms posted on our website

These electronic communications satisfy any legal requirement for written notice.

15. Termination

15.1 Termination by You

You may terminate your account at any time by:

Canceling your subscription through account settings
Contacting support at support@domainpilot.io
Following the account deletion process in your dashboard

Termination takes effect at the end of your current billing period for paid accounts, or immediately for free accounts.

15.2 Termination by Us

We may terminate or suspend your account immediately, without prior notice or liability, for any reason, including but not limited to:

Breach of these Terms
Abusive, fraudulent, or illegal activity
Violation of Acceptable Use Policy
Failure to pay fees when due
Discontinuation of the Service

ACCOUNTS TERMINATED FOR VIOLATIONS ARE NOT ELIGIBLE FOR REFUNDS.

15.3 Effect of Termination

Upon termination:

Your right to access and use the Service immediately ceases
We may delete your account data and configurations
Outstanding fees become immediately due and payable
You must cease all use of our trademarks and intellectual property
Sections of these Terms that should survive shall remain in effect

15.4 Data Upon Termination

Upon termination, we may:

Retain your data for a reasonable backup period (typically 30 days)
Permanently delete your data after the retention period
Retain certain data as required by law or to resolve disputes

IMPORTANT: We do NOT maintain backups of your domain data indefinitely. You are responsible for exporting any data you wish to retain before termination.
